2020 AGILE VIRTUAL SUMMIT
Terms of Service
This agreement (“Agreement”) is between you (“You” or “Your”) and Weisbart Consulting, Inc. (“Our” or “We” or “Us”) and governs Your registration and/or participation in the 2020 Agile Virtual Summit (the “Summit”). By registering for the Summit, You agree as follows:
LIVE EVENT: The Summit will offer streaming of live programming from June 1 - 5, 2020 (the “Live Event”). During the Live Event, You may have the opportunity, at Your own caution, to interactively participate and to share personal information. We do not promise or guarantee the confidentiality of any information that You choose to share with any presenters, groups, or other registrants.
ON-DEMAND AND BONUS CONTENT: Bonus content (“Bonus Content”) and on-demand access to Live Event presentations will only be available for registrants choosing an All Access Pass.
REGISTRATION LEVELS: We offer two levels of access to the Summit: free access (“Free Access”) and all access pass (“All Access Pass”).
FREE ACCESS: If You register for Free Access, You may stream live programming during the Live Event without charge. If You choose Free Access, You will not have on-demand access to the Summit’s programming, and You will not have access to Bonus Content from speakers.
ALL ACCESS ACCESS PASS: The cost of All Access Pass is $297 per registrant minus any discount you may be offered. If You register for All Access Pass, You may livestream the Live Event and You will also have on-demand access to the Summit’s programming, and to Bonus Content from the speakers.
EMAIL ADDRESS: In order to register for the Summit, You agree to provide Us with Your name and email address. You also agree that We may use Your name and email address for Our marketing purposes. You may opt out of Our marketing emails by following the “unsubscribe” instructions in one of Our marketing emails.
REFUND POLICY FOR ALL ACCESS PASS: You must provide Us notice before July 6th, 2020 or 30 days after Your purchase (whichever is later) if You are requesting a refund for any reason. To request a refund, You must email Us at [email protected] no later than July 6th, 2020 or 30 days after Your purchase date (whichever is later). We will not issue a refund if You request a refund after July 6th, 2020 or 30 days after Your purchase date (whichever is later).
SYSTEM REQUIREMENTS: To participate in the Summit, You must have access to the Internet, and an up-to-date modern web browser. We disclaim any liability arising out of failures of Your computer system or network, or Your inability to access the Summit because of Your computer system or network.
SPEAKER CONTENT; NO GUARANTEES: Summit speakers have independently prepared their content, presentation, promotions, and materials. Speakers are not Our agents, and their content, presentations, promotions, and materials are being offered solely on their own behalf. We are not making any promises or guarantees about the speakers’ content, presentations, promotions, or materials. The information the speakers share is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. We disclaim all liability for errors or omissions that appear in speaker content, presentations, promotions, or materials. You agree to waive and release any and all claims against Us for claims arising out of speaker content, presentations, promotions, or materials.
LIMITATION ON TYPE AND AMOUNT OF DAMAGES AGAINST US AND SUMMIT SPEAKERS: The maximum total recovery for all claims that You assert against Us and/or Summit Speakers, whether based in contract, tort, equity, or otherwise, shall be limited to the cost of Your registration. Neither We nor any speaker shall be liable for any incidental, consequential, indirect, or punitive damages, however caused, and regardless of the theory of liability.
OUR RIGHT TO EDIT AND REMOVE CONTENT: We reserve the right to add to or remove on-demand content and Bonus Content at any time and without notice to You. In the event that We close the Summit and cease to offer any on-demand content, and if You have an All Access Pass, We will provide You with thirty (30) days’ emailed notice so that You may finish watching on-demand content before it is removed.
YOUR PROMISE THAT YOU WILL NOT INFRINGE ON INTELLECTUAL PROPERTY: You promise that You will not infringe on Our or any speaker’s copyright, trademark, or other intellectual property rights. In addition to other remedies available to Us and the speakers, We will have the right to seek injunctive relief in court to stop You from Your infringing behavior, as well as the right to seek damages against You.
LOGIN AND ACCOUNT: You agree that You will not share Your user name and/or password (“Your Login or Account”).
NO IN-PERSON EVENT: There will be no in-person, face-to-face event at the Summit.
CODE OF CONDUCT: You agree to follow the code of conduct outlined here, and understand not doing so may lead to being barred from this and future events. We do not actively moderate content, so any harassing or offensive behavior must be brought to Our attention by emailing [email protected] The comments, statements, and opinions of attendees are not made on Our behalf.
WASHINGTON AND UNITED STATES JURISDICTION: You agree that by registering for and/or participating in the Summit, You submit to the jurisdiction of the State of Washington and the United States of America.
By registering for our event, You certify that You read, understand, and agree to the above terms and conditions.
